1. Acceptance of Terms

By accessing or using El Taco Fish POS ("the Service"), whether through our iOS application, Android application, or web application, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

El Taco Fish POS is a point-of-sale platform for restaurant management. The Service is available on the following platforms:

• iOS — available on the Apple App Store
• Android — available on Google Play
• Web — accessible via web browser

The Service includes features such as menu management, order processing, kitchen display, analytics, and payment processing integrations.

3. Subscriptions and Billing

El Taco Fish POS offers subscription-based access with the following tiers:

• Basic — core POS features for restaurant operations
• Premium — advanced features including kitchen view, seat-based ordering, modifiers, and device payment integrations

Payment Processing

Payment is processed by the platform through which you subscribe:

• iOS — payment is processed by Apple through your iTunes Account. By subscribing on iOS, you also agree to Apple's Licensed Application End User License Agreement.
• Android & Web — payment is processed by Stripe.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

Managing and Canceling Subscriptions

You may manage or cancel your subscription at any time:

• iOS — go to Settings > Apple ID > Subscriptions on your device, or visit Apple Subscription Management.
• Android & Web — manage your subscription from your account settings within the application.

Cancellation takes effect at the end of the current billing period. You will retain access to subscription features until that date.

Refunds

Refunds are handled by the respective platform. For iOS purchases, request a refund through Apple at reportaproblem.apple.com. For Android and web purchases, contact us directly.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. A single account may be used across all supported platforms (iOS, Android, and Web).

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized third parties

6. Intellectual Property

The Service, including its design, features, and content, is owned by El Taco Fish and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Limitation of Liability

To the maximum extent permitted by law, El Taco Fish shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Any active subscription will not be refunded upon termination for cause.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Mexico. Any disputes arising from or relating to the Service shall be resolved in the courts of Puerto Vallarta, Jalisco, Mexico.
